1. Preamble

BRAINWAR production s.r.o., with its registered office at Kramolná 2454/31a, Horní Počernice, 193 00 Prague 9, ID No.: 04433017, registered with the Municipal Court in Prague under File no.: C 247617 (hereinafter also referred to as “BRAINWAR“) has developed and sells the exercise application “KINI” (hereinafter also referred to as “Application” or “KINI“), which is available in the App Store or Google Play (hereinafter also referred to as “App store(s)“), and operates the website www.kini.cz, which contains basic information about the Application (hereinafter also referred to as “Website“).

With regard to the purchase, download and installation process, some of your personal data is processed by the App store operators. We have no influence on this collection and processing of personal data. The terms and conditions for the processing of your personal data in the context of your purchase in the App stores are available below (these links may be changed over time)

Why do we have this Policy?

This Policy describes

  • the ways in which the Application collects, stores and processes your personal data when you install and use the Application,
  • processing of your personal data when using the Website (including cookies),

all in accordance with the General Data Protection Regulation (GDPR) and other relevant legislation.

2. Processing of personal data during registration and use of the Application.

Which personal data do we process?

When registering for our Application, you will be asked to provide your first name, last name, date of birth and email address (also referred to as “Personal Information“). However, other data that does not necessarily meet the definition of Personal Data in this case and that we may process are: the IP address / device ID of the mobile terminal device used, the date and time of access, the request from the client, the http code of the response, the version of the Application. We do not collect any other data about your health or physical condition, however, please pay attention to the terms of use of our Application, which are available on the Website (T&C). For the sake of completeness, we also do not process your payment or credit card details, payment for the provision of our services is processed through the App stores. If you voluntarily provide us with additional data in the course of your communication with us, you do so voluntarily and give us your consent to process it, and this Policy applies to this data as well.

Why do we process personal data?

We process your Personal Data mainly for the following reasons:

  • so that we can provide you with access to the Application, i.e. so that we can create a user account for you and keep it active for a period of time of your choosing;
  • to identify you and verify that you are an authorized user of the Application;
  • if necessary, so that we can provide you with customer support and communicate with you;
  • so that we can send you notifications about updates to the Application, new features, price list changes, special prices or bug fixes or other relevant news;
  • so that we can personalize your use of the Application and make your experience more enjoyable;
  • and to meet our obligations to you and to properly perform our legal duties.

 We will not use your Personal Data for any other purpose unless you give us your explicit consent to do so.

3. Processing of Personal data when using the Website

Which personal data do we process?

We process your IP address and cookies when you visit or move around our Website.

Why do we process Personal data?

To provide you with access to the Website and the information contained therein. We may also use the above information to administer and improve the Website and for the purposes of providing internal operations, including troubleshooting, data analysis, testing, research, statistical purposes and to record the frequency of views. This data may also be used to measure the effectiveness of advertising and to provide relevant advertising.

4. Who may have access to Personal Data?

We work with certain partners for the provision of our services, i.e. the operation of the Application and the Website, and they may have access to Personal Data, but they are bound by the same (similar) protections as we are. These partners are:

5. Retention period of Personal Data

We hold Personal data only for the period of time strictly necessary for the performance of our contractual obligations arising from your use of the Application and for the performance of our obligations under applicable law. We will only retain personal data that is processed on the basis of your consent for the duration of the purpose for which the consent was given. Once the lawful basis on which your Personal Data is processed has ceased to exist, we will destroy that Personal Data and any existing copies of it.

If we assess that it is necessary to archive the Personal Data or it is necessary to process it for a longer period of time, in particular to protect our rights and legitimate interests (e.g. to assert rights arising from defects in the service provided by the Application in the context of a complaint or lodged complaint, or to assert another claim, etc.), we may do so, but not for more than 15 years after the end of your access to the Application.

The relevant legislation guarantees you these rights in relation to the processing of Personal Data:

  • The right to access your personal data,
  • The right to rectification of personal data or restriction of processing,
  • Right to erasure of personal data,
  • Right to object to processing,
  • Right to data portability,
  • The right not to be subject to any decision based solely on automated processing, including profiling, which has legal effects on the customer or similarly significantly affects the customer,
  • The right to withdraw consent to the processing of personal data at any time to the extent that it has been granted.

7. Cookies when visiting the Website

Cookies are small text files that websites store on your computer or mobile device when you start using the website. We do not use cookies for anything other than purely technical purposes, we do not associate the data obtained through cookies with any other data and we work with cookies in such a way that they do not allow the identification of specific persons.

This Website contains third-party cookies that are used to obtain anonymous statistics about traffic and typical behaviour on individual pages. This Policy is effective as of 01.04.2023 and may only be amended in writing and you will be notified of this via our Website.
